Once a firearm is received into Dealer's possession, it shall remain on consignment with Dealer for a minimum of thirty (30) days from the date of intake, regardless of the consignment term selected above. During this minimum period the firearm will not be released back to the Consignor, including in cases where the Consignor has located or has a prospective buyer interested in the firearm. Any such buyer may purchase the firearm through Dealer at the listed price during this period.

Online Sales Authorization (Consignor Initials Required)

Dealer is authorized to advertise and sell the firearm through in-store display, dealer networks, and third-party online marketplaces, auctions, or classified platforms at Dealer's discretion. Dealer controls photographs, descriptions, pricing presentation, and shipping terms required by such platforms. Marketplace and processing fees may be deducted prior to calculating Dealer proceeds.

Price Adjustments

Dealer may contact Consignor to request authorization to reduce the asking price in order to facilitate sale. No reduction of the asking price or agreed net amount will occur without consent of the Consignor.

Background Check or Transfer Failure

If a prospective purchaser fails a background check or the transfer cannot legally be completed, the firearm shall remain on consignment unless Consignor requests its return, subject to the Minimum 30-Day Consignment Period.

Early Withdrawal by Consignor

After the Minimum 30-Day Consignment Period has passed, Consignor may request return of the firearm prior to expiration of the consignment term. Dealer may charge an administrative fee of $100 to cover intake, marketing, listing, and handling costs. Return of the firearm must comply with all federal and Florida firearms laws and may require completion of ATF Form 4473 and other required procedures.

Unclaimed or Abandoned Firearms

If Consignor fails to retrieve any firearm within thirty (30) days after written or electronic notice that the consignment term has expired or the firearm is ready for return, Dealer may assess reasonable storage fees. After the statutory holding period required under Florida law, the firearm may be deemed abandoned and may be sold or otherwise lawfully disposed of. Any proceeds may be applied toward storage and administrative costs with remaining funds handled in accordance with Florida law.

Liability

Dealer will exercise reasonable care in handling and storing consigned firearms. Dealer shall not be liable for normal handling wear, mechanical defects, depreciation, or manufacturer defects. Dealer liability for loss or damage shall not exceed the agreed net amount (or, under the commission option, eighty percent (80%) of the asking price) listed for the firearm.
